Overview

Welcome to Arizona Boardwalk (the “Site”). The terms “we,” “us,” “our,” “Arizona Boardwalk,” or “Boardwalk” refer to Northern Gateway LLC (or the entity that owns/operates the Site and attractions). By accessing or using the Site (including browsing its pages, purchasing tickets, or engaging with any content), you (“you,” “user,” “visitor”) accept and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to all of these Terms, you should not use the Site or its services.

These Terms, together with any policies referenced herein (e.g. Privacy Policy, Refund Policy, Event Policies) and any rules posted from time to time, form the entire agreement between you and Arizona Boardwalk regarding your use of the Site.

We reserve the right to modify or update these Terms at any time (for example, to reflect changes in law or our practices). When we do, we will revise the “Last updated” date. Your continued use of the Site after such changes constitutes acceptance of the updated Terms.

1. Use of the Site & Eligibility

  1. You represent and warrant that you are at least 18 years old (or have the legal capacity in your jurisdiction) or have parental/guardian consent to use the Site.
  2. You agree to use the Site only for lawful purposes and in a way that does not infringe on rights of, or restrict or inhibit the use by, others.
  3. You will not (and will not try to) interfere with the security of the Site or otherwise abuse it (e.g. hacking, sending harmful code, spamming).
  4. We reserve the right to refuse service, terminate accounts, or block access to the Site to anyone at any time for any reason.

2. Tickets, Events, & Attractions

Since Arizona Boardwalk is an entertainment / attractions venue, this section addresses how we manage ticketing, admission, scheduling, cancellations, etc.

2.1 Ticket Purchase & Admission

  • All ticket sales are subject to availability, and having a ticket does not guarantee entry if capacity limitations, force majeure, or other restrictions exist.
  • You must present a valid ticket (physical or digital) and may be required to show ID.
  • Tickets are non-transferable unless otherwise stated.
  • Resale or commercial use of tickets without our permission is prohibited.

2.2 Event & Attraction Schedule

  • Attraction hours, event schedules, prices, and availability can change without notice.
  • We are not responsible for lost, stolen, or damaged tickets once issued.

2.3 Cancellation, Refunds & Changes

  • We may cancel or modify events or attractions (dates, times, scope) for operational, safety, weather, or other reasons.
  • Our refund, exchange, or cancellation policy is set forth in our Refund / Cancellation Policy (linked separately).
  • If an event is canceled entirely by us, we may issue refunds, credit, or rescheduled tickets, at our discretion.

2.4 Visitor Conduct & Safety

  • You agree to follow all posted or announced rules, directions from staff, safety instructions, signage, and applicable laws while on property.
  • We reserve the right to deny or revoke admission or require you to leave for misconduct, safety risks, or breach of Terms.
  • You assume all risks of injury or damage from participating in attractions, subject to applicable law.

3. Content, Intellectual Property & Use Restrictions

  1. All content on the Site (text, graphics, logos, images, video, audio, software) is owned by or licensed to us, and is protected by copyright, trademark, and other intellectual property laws.
  2. You may view, download, or print portions of the content for personal, noncommercial use only, provided you keep all copyright or proprietary notices intact.
  3. You may not reproduce, publish, distribute, adapt, modify, create derivative works of, reverse engineer, or otherwise exploit the Site content without our prior written permission.
  4. If you post or submit any comments, feedback, ideas, or other materials (e.g. event reviews, suggestions), you grant us a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, distribute, and display such materials in any media.

4. Accuracy of Information

We strive to maintain accurate, complete, and up-to-date information on the Site (e.g. event times, pricing, capacity). However:

  • We do not guarantee that information is accurate, complete, reliable, or error-free.
  • We may correct errors, update information, or change or remove content without prior notice.
  • Your reliance on Site content is at your own risk.

5. Third-Party Links & Services

  • The Site may contain links to other websites or services not owned or controlled by us.
  • We are not responsible for the content, policies, practices, or security of third-party sites.
  • Your interactions with third parties (e.g. vendors, partners, ticketing services) are at your own risk.
  • We do not endorse, guarantee, or assume liability for third-party offerings.

6. Disclaimers, Warranties & Limitations of Liability

  • THE SITE, ITS CONTENT, AND ALL SERVICES (INCLUDING ATTRACTIONS, EVENTS, TICKETS) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT).
  • WE DO NOT WARRANT THAT ACCESS TO THE SITE OR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR LIABILITY (AND THAT OF OUR AFFILIATES, EMPLOYEES, AGENTS, PARTNERS) FOR DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES IS LIMITED to THE AMOUNT YOU PAID (IF ANY) FOR TICKETS OR SERVICES. In no event shall we be liable for indirect, incidental, punitive, or consequential damages (lost profits, data, etc.), even if advised of the possibility.
  • Some jurisdictions do not allow disclaimers or limitations of liability for certain damages; in such cases, our liability is limited to the fullest extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless Arizona Boardwalk and its officers, directors, employees, agents, contractors, partners, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including attorneys’ fees) arising from or relating to:

  • Your breach of these Terms;
  • Your use of the Site or services;
  • Your violation of any rights of a third party;
  • Your negligent, willful or unlawful conduct.

8. Termination

  • We may suspend, disable, or terminate your access to the Site or any portion thereof at any time, for any reason, with or without notice.
  • Termination does not relieve you of liabilities or obligations incurred before termination.
  • Sections that by their nature should survive (e.g. indemnification, liability limitations, intellectual property, governing law) survive termination.

9. Severability & Waiver

  • If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
  • Our failure to enforce any right or provision shall not act as a waiver of that right or provision in the future.

10. Governing Law & Dispute Resolution

  • These Terms and your use of the Site are governed by the laws of the State of Arizona (without regard to conflict of law principles).
  • Any dispute or claim arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in [County], Arizona, and you submit to the personal jurisdiction of such courts.
  • If a court finds any portion of this dispute resolution clause invalid or unenforceable, the remainder still applies.
